Working with a finance solicitor

A finance solicitor is a solicitor who can advise a client of the law regarding financial matters. A finance solicitor does not advise on the merits of any financial activity but advises on its legal consequences for the client. For example, a finance solicitor should not advise clients on whether to buy or sell shares in a company, but can advise on how the buying or selling of shares will affect their voting rights in that company. However, many law firms will have in-house financial advisors to offer the whole package of financial services to their clients.

Finance solicitors can advise individuals and companies alike on finance law. Commercial finance solicitors will advise their corporate clients on many aspects of their business, from management buy-outs to financing acquisitions. They can advise on raising capital through equity and initial public offerings. They will be experts in the financial procedures set out in the Companies Act 2006.

For individuals the main areas of advice given by finance solicitors relate to bankruptcy, borrowing, mortgages, challenging a decision by HM Revenue & Customs, inheritance tax, and tax planning. Bankruptcy is petitioned for at the courts when an individual is not able to repay their debts. It allows an individual to wipe their slate clean, but it can have consequences on their future credit rating. Alternatively, an individual voluntary agreement (IVA) can be drawn up by a finance solicitor which structures repayments to creditors in a manageable way.

If you are having financial difficulties help from a finance solicitor is recommended. Finance law is a complicated and often-technical area of law which requires expert knowledge
