Using lawyers for salary and employment advice

 

The UK has a complicated system that governs employment law. On occasion employers and employees alike require legal advice regarding their pay schemes and salary. Lawyers who specialise in employment law can provide that much-needed guidance.

A sub-specialisation which deals with specific areas of employment law (such as freelance, contract work, pensions etc) is common amongst employment lawyers. Salary however, is not usually considered a sub-specialty – instead employment solicitors are likely to have detailed knowledge about their area of expertise and the specific salary rules which apply to that area. If solicitors are approached regarding an area of law they are unfamiliar with it is a violation of their code of conduct to advise on it. They are more likely to research the topic thoroughly before offering any advice.

It is important to remember that solicitors are unlikely to be familiar with your specific employment contract, and will therefore be reluctant to provide you with general advice. There are several reasons for this; firstly, a solicitor who provides inaccurate advice exposes themselves to the risk of being sued for negligence. Secondly, the law nearly always has exceptions, and providing generic advice may lead the recipient of such advice to a wrong conclusion with regard to their specific situation. A solicitor should always see your contract before advising you.
