The NHS Litigation Authority
When you bring a claim for clinical negligence against the NHS, the NHS Litigation Authority handles the contact between your solicitor and the medical establishment you are bringing your lawsuit against. Within the NHS Litigation Authority is the Clinical Negligence Scheme for Trusts that has handled all claims for compensation due to clinical negligence since April 1995.
As the NHS Litigation Authority is acting on behalf of the NHS body you are suing, they cannot give you any help or advice about your case. Any questions you have should be directed to your solicitor.
The NHS Litigation Authority also only handles lawsuits that are seeking financial compensation. If you are simply making a complaint, even if you are using a solicitor to do this, the NHS Litigation Authority won’t be involved.
Currently all the NHS Trusts and Primary Care Trusts are members of the Clinical Negligence Scheme for Trusts scheme. Your clinical negligence solicitor will spend much of their time in contact with this branch of the NHS Litigation Authority as they consider your claim.
