Solicitors in Northampton
Northampton is one of the largest UK towns as it is not technically a city. Historically the town was famous for shoe production, although most of the industry has now left. The case came about after a 14 year-old quadriplegic boy died whilst in the care of the Northamptonshire Health Care Trust. The boy died from a medical complication in his bowel. The coroner for Northampton learned the cause of death after a post-mortem examination and decided that there was no evidence to indicate the death was unnatural, and therefore no reason for an investigation regarding the death.
Canning disagreed with the coroner’s conclusion, and argued two things; that the boy would not have died had the care takers been more vigilant and surgeons were able to treat the boy sooner, and that any death occurring under state supervision must be investigated as a matter of human rights. The court decided that although there was some evidence the child would have been saved had he received medical treatment earlier, the coroner was within her rights to refuse to treat the death as unnatural, and the human rights argument was not appropriate.
