Power of attorney and lawyer advice

A power of attorney is a legal way in which to give authority to others in order to enable those others to manage your affairs for you. A lasting power of attorney is the main type of power of attorney now, the enduring power of attorney having been replaced on 1 October 2007. An enduring power of attorney can no longer be created although they can still be used to act for a person and can be registered with the Office of the Public Guardian.

A lawyer can help you to set up a lasting power of attorney, whether you want to appoint a friend, professional or a relative to hold the power of attorney. A lawyer can help you with drawing up the legal document and registering a lasting power of attorney with the Office of the Public Guardian to give it legal effect. A lasting power of attorney can be used at any time whether you have the mental ability to act for yourself or not.

There are two types of lasting power of attorney; a property and affairs lasting power of attorney, and a personal welfare power of attorney. A lawyer can advise you on the differences between the two types: a property and affairs lasting power of attorney allows you to choose a person to make decisions about how to spend your money, while a personal welfare lasting power of attorney allows you to choose someone to make decisions about your healthcare and welfare.
