Personal injury claims are brought when a person has suffered injury which was caused by another person. The personal injury solicitor will start by investigating the claim and finding out whether another person, company or agency is responsible for the injury. If another person is responsible, the personal injury solicitor will gather evidence, instruct experts and negotiate with the other side for settlement of the claim. If settlement is not possible, either because the defendant denies liability, because a figure for settlement cannot be agreed, or because the defendant has failed to respond to letters from the claimant's solicitor, the solicitor will lodge the personal injury claim with the court.

Personal injury claims should not be commenced at court until the claimant's solicitor has undertaken a number of procedural steps. He should be sure he has all the evidence on the claim relating to both the liability of the defendant and the amount of money he should pay. The claimant's solicitor should also ensure that he has properly followed the protocol relating to the type of personal injury claim the defendant is bringing. Once the personal injury solicitor is satisfied that he is ready to issue the claim, he will send the claim form to either the county court or the high court depending on the value and complexity of the claim and to the defendant.
