Personal injury cases are legal cases brought by people who have suffered an injury that was the fault of another person, company or agency. With changes in the way personal injury cases are funded and changes in British culture, there have been large increases in the amount of personal injury claims made.

Personal Injury Cases are brought to court where negotiations have failed or where the defendant has failed to respond to letters from the claimant's solicitor. The claimant's solicitor will send the claim form to the court and to the defendant (or the defendant's solicitor if he has one). The claim form will be sent with the 'particulars of claim' which must contain the details of the claim accurately and comprehensively. Failure to complete the particulars of claim properly can result in the claim being struck out by the court.

The defendant will then respond to the claim by: defending the claim, admitting the claim or acknowledging service of the claim form.If the defendant makes no response to the claim form then it is possible for the claimant to ask the judge to enter 'default judgement', this means asking the judge to decide the case without input from the defendant.
