Negligence in construction

 

In any other profession experts have a duty of care towards their clients and sometimes towards third parties. Any breach of this duty, from which loss or personal injury is sustained, can result in a claim against the negligent professional. Construction negligence claims are no different to other types of negligence claims and they can be pinned against any party involved in the construction process from contractors, architects, quantity surveyors, engineers, project managers etc.

Many construction accidents involve employees and employers have a responsibility to ensure that those working on construction sites are safe. This means providing the correct equipment, training, suitable lighting and ventilation. Construction negligence can lead to many types of accidents, including:

Quite often construction negligence can result in a claim brought by the injured party, based on their contract with the expert concerned. However, if a contract does not provide for loss or damages, due to the lack of a contractual relationship or for any other reason, then a case may be pursued in what is known as the law of tort. This allows an innocent victim to make a non-contractual claim provided the loss suffered is reasonably foreseeable and not too remote. Compensation may not be able to reverse the effect of any loss or injury suffered but it can certainly go a long way, particularly as the construction industry is heavily regulated and strict safety and indemnity policies are supposed to be in place to prevent the effects of construction negligence.
