Transferring the ownership of land or property is known as conveyancing. While anyone can carry out a conveyance, it normally requires the knowledge and expertise of solicitors or licensed conveyancers. A licensed conveyancer is a specialist property lawyer who is qualified to deal with all property matters. They have the same professional privileges as those of a solicitor and in many cases a reference to a solicitor will include licensed conveyancers.

Professional conveyancers are required to carry out the administrative work involved in a transaction. They have to carry out various searches and interpret important documents that ordinary members of the public may find difficult translating including: an official property plan and a copy of all the entries on the property register from the land registry; a draft contract; a completed fixtures and fittings form as well as answers to the buyer’s questions about the property. Licensed conveyancers must also deal with mortgages and filing a Stamp Duty Land Tax (SDLT) return form and preparing a Transfer Deed.

Most conveyancing transactions run relatively smoothly, but sometimes problems can arise with: rights of way, boundary disputes and planning matters, to name a few. All of these require expert attention and therefore a licesed conveyencer or solicitor should always be used. It is sometimes found that licensed conveyancers' fees are more competitive when compared with some solicitors and are therefore often favoured. However, both have the same obligations to observe the best interests of their clients and therefore they should both provide an equally efficient service.
