Getting help from solicitors for child law matters

There are many aspects of the law which relate to children specifically. From laws governing the ages at which children can participate in certain activities, to laws protecting the care and welfare of children in family situations, the law aims to protect children by providing extra rules and regulations. Solicitors who specialise in child law are often involved in unfortunate and difficult cases relating to children in danger of abuse or substandard care.

Other matters of child law that solicitors may deal with are complications resulting from adoption requests and children’s rights. The complexities of this area of law can be seen in the case known as Re: L (A Child) (Care: Assessment: Fair Trial). In this case a mother had been forced to give up her newly born child for adoption after a previous child died in her care from what appeared to be non-accidental injuries. The decision was appealed by the mother because she was refused a request to be present during the decision-making process and she claimed that this refusal was a violation of her rights to a fair trial. The appeal was unsuccessful because the court found that the decision had been reached as a direct result of the mother’s behaviour (specifically the mother’s refusal to take responsibility for the death of her previous child). Therefore the court did not find it to be her right to be part of the decision-making process.

This case illustrates the complexity and sensitivity of dealing with cases involving children. If you are having a legal dispute related to child law, solicitors who specialise in this area will be able to help you understand the legal issues related to your case, and tell you what your options are.
