Five FAQs about copyright
What is copyright?
Anyone who creates a work of literature, a painting, dramatic or artistic piece of art is said to be the copyright holder of that work. Your copyright solicitor will explain that you can’t copyright an idea, but only the expression of that idea. Once you have expressed your idea – by writing it down for instance – you instantly assert your copyright ownership of that work.
How does copyright ownership benefit me?
As the copyright owner of your work you can assert your rights if someone else wants to use your work in some way. A good example is with photography. Once you have taken a picture, you become the copyright holder. You could then sell the copyright or licence your photo for a sum of money. Your solicitor can explain how the legalities work when selling or licensing copyrighted materials.
Can I legally use another person’s copyrighted work?
Yes, as long as you have asked for and obtained their permission. It is always a good idea to get any permission you been granted in writing. This can then be used as evidence should the copyright holder decide to sue you for copyright infringement. Your solicitor can assess the permission you have been given, and relate this to how you would like to use the copyrighted materials.
Is my copyright protected overseas?
No, as generally each country has developed copyright laws with which you must comply. These laws are all broadly similar, but it is a good idea to contact a specialist copyright law solicitor to check your copyright is protected in the countries you are interested in.
How can a solicitor help me protect my copyrighted work?
The law of copyright has been in existence for decades. With the advent of the Internet, copyright law has had to change to meet these demands. A specialist solicitor can assess the work you want to copyright and advise on the best course of action. And more importantly, a solicitor is vital if you want to bring a case of copyright infringement and sue for damages.
