Mediation is a series of meetings in which you and your spouse come together to discuss issues face-to-face. A mediator will sit in the meetings with you, acting as an impartial third party. They will promote agreement by guiding the two parties through the resolution process, ensuring that you and your spouse discuss the issues that matter and leave any aggression at the door.
Mediators are specially trained by either the National Family Mediation service or a similar body and are recognised by the Legal Services Commission. It is because of this specialist training that mediators are able to skilfully draw out the important matters and use the information given in the meetings to present various options which the two parties may use as a basis of agreement. However, although divorce mediation services can provide options and a ‘safe’ arena for discussion, the mediator involved cannot tell either party what they should do. A mediator is not a substitute for a divorce solicitor, who can provide you with the proper legal advice and can explain the procedure you must follow in order to obtain a legal divorce.
