Conveyancing contract

 

A conveyancer is a solicitor who assists on the legal aspect of buying or selling properties. Their role is both vast and complex as they deal with everything from the contractual to the financial side of the transaction.

There are few different types of conveyancers available for legal advice. There are solicitors who work in general practice but who also do conveyancing and there are licensed conveyancers who have taken the exams and undergone training set by the Council of Licensed Conveyancers. Despite this difference, both types of conveyancers are equipped to handle simple property transactions. A licensed conveyancer may be more useful for a large property or a complex conveyancing contract.

But what do conveyancers actually do? In conveyancing, contract work is key as this is what your conveyancer will be working towards from the moment they are instructed. Once contracts have been exchanged between the parties, there is no going back without paying damages or compensation. In the interim, the conveyancer will draft, arrange and negotiate the contract until it is satisfactory for both parties.

A conveyancer will begin by taking instructions from their client and then start on the large amounts of paperwork necessary for the transaction, including a client care letter. The buyer’s conveyancer will begin local authority searches and enquires about the property to elicit information that the seller is not bound by law to disclose. Meanwhile, the seller’s conveyancer will ensure that the seller does make any misrepresentations about the property. The conveyancer will also look into getting structural surveys and file any applicable planning permission applications. Finally the conveyancer will deal with the financial aspect, including stamp duty land tax and mortgage fees before concluding the conveyancing contract. The conveyancer can also act for both a buyer and a standard mortgage lender such as a bank or building society.
