Construction law and arbitration

 

If you have had any construction work carried out at your home or business premises and feel that the contract you had with your builder has not be fulfilled, you may be thinking of taking legal action. A lawsuit to sue your builder or contractor can potentially be a long and expensive process. If at all possible it is preferable to try and resolve your dispute outside of a courtroom.

Construction law and arbitration simply means that you are willing to attempt to settle the issues you have with your contractor or builder without resorting to court action. You will be aware of mediation and conciliation services such as ACAS that large business sometimes use. You too can use a form of conciliation when attempting to resolve your dispute.

Not all construction law will lend itself to arbitration. You may feel that some form of compensation is the only recompense you are prepared to accept. If this is the case, then you must contact a solicitor immediately. They can give you detailed help and advice about the case you want to bring against your builder or contractor.

If you are prepared to use construction law and arbitration to try and settle your dispute it is also a good idea to use the services of a solicitor. Your contractor or builder will invariably have their own legal representation when you meet to discuss your dispute. You too should always have legal representation each time you meet to discuss your dispute. This ensures that any points of law are properly interpreted and that arbitration has a good chance of success.

Your use of construction law and arbitration will usually be handled by a third-party mediation service. In England and Wales mediators must be members of the Civil Mediation Council. Scotland has the Scottish Mediation Register, and if you are in Northern Ireland you can contact the Labour Relations Agency for help and advice.
