Construction defects in your home
The house that you live in should have been built to precise standards set out in the current building regulations. Sometimes a construction defect will make itself known immediately, or it could become apparent several years later.
If your home does have a construction defect, you could make a claim for compensation. If the defect is serious, the compensation you could receive may total the cost of making the repair to your home, and an amount of money that is equal to the decline in value your home has suffered because of the defect. Your solicitor may also be able to claim for the cost of temporary accommodation you had to use while repairs were carried out and any court costs you have had to pay.
A construction defect could also occur if you have contracted a builder to make alterations to your home or business premises. You should have a full construction contract in place that gives precise details of the work to be carried out. If after the work is complete you feel that it contains a construction defect - perhaps highlighted by the buildings inspector - you could make a claim for compensation against the builder.
When entering into any construction-defect dispute it is vitally important to have legal representation at every stage of your case. This is particularly important if you do not have a contract with your builder. You can still bring a lawsuit against them that your solicitor will fight on your behalf.
