If you have suffered an accident due to someone else’s negligence, you may be able to claim compensation for personal injury. This compensation for your loss may be awarded by a court or an out-of-court settlement. Before your case gets to court it is important that procedures set out in the ‘Civil Procedure Rules’ are adhered to. It is for the claimant to write a letter of claim to the defendant detailing how they are liable for the accident and how much compensation they believe they should be awarded. If the defendant agrees that they are liable, they are still unlikely to agree on the amount of compensation. Your solicitor will then be responsible for negotiating a sum with the defendant.

If your case goes to court and is successful, the compensation for the personal injury suffered is worked out by the judge by awarding compensation for each type of loss suffered. The judge will look out how much money you have already lost from having the injury - including loss of earnings, medical bills, cost of nursing care and other financial losses up to the date of the hearing. The judge will then look at how much money you are likely to lose in the future and will look at the pain and suffering you have endured as the result of your injuries. The judge will then give a figure that the defendant must pay the claimant in damages.
