Compensation for a crush injury

A crush injury is when part of a person’s body is crushed between two heavy objects, or a heavy object and an unyielding surface, and the high degree of pressure causes an injury. Crush injuries can range from minor bruising to the amputation of a limb. They can also include bleeding (including internal bleeding), fractures, open wounds and swelling. In the case of a crush injury to the head, brain damage could result. Therefore crush injuries can be serious.

A crush injury can occur as a result of many different accidents in many different contexts. Health and safety failures at work, especially in workplaces with heavy machinery, are a common cause of crush injuries. They can also occur in road traffic accidents, and as a result of being crushed by cattle. A common cause of crush injuries is in a crowd, for example, at a pop concert or sporting event. Crush injuries can also occur when something is dropped from a height and it lands on a passer-by. This is a particular hazard on or near building sites.

If a crush injury does happen to you, you may be entitled to claim compensation from the person or organisation responsible. Personal injury solicitors are experts in getting compensation for the victims of crush injuries. They can either negotiate a settlement with the responsible party or, failing that, take your claim to court. The amount of compensation entitlement would depend on the severity of the crush injury and how long it will take to recover. It is important to remember that personal injury claims must be brought within three years of the accident that caused the injury.

Many personal injury solicitors will offer a no-win, no-fee service for compensation claims for crush injuries. This means that if your compensation claim is unsuccessful, you will not owe your solicitor any fees. However, if your claim is successful, you may be obligated to pay your solicitor fees if these are not recoverable from the other side. Let Contact Law match you to a solicitor, and they will be able to give you more information.
