Compensation claim

 

You may have a compensation claim against another party in a number of situations. For example, if you have been involved in a road traffic accident which was not your fault, you may have a compensation claim against the culpable party. Another scenario in which you might have a claim for compensation is if you suffer a personal injury whilst at work.

A claim can arise out of contractual agreements. A contractual agreement between parties can be agreed orally, or in writing. For a contractual agreement to be legally binding there has to be some sort of consideration offered in return for the goods/services being rendered. This is normally a monetary amount. For example, agreeing to pay a satellite engineer £65 to fix your satellite dish is agreeing a consideration.

If any of the parties breach any terms of the contract then the other party or parties may have a compensation claim against that party for the breach of contract.

A compensation claim can also arise in cases where you do not have contract. For example, in a road traffic accident you do not have a contract with the other driver. However, if the other driver did not drive with the reasonable care and skill expected of a competent driver, you could sue them for negligence.

Negligence is a tortious claim. Claims in tort law do not require there to be a contract between parties. There are other requirements which a claimant must meet.
