A review of your rights under environmental law
It is important for us as individuals to constantly review environmental law and our rights under it. Environmental law is the area of law which seeks to protect the environment and how businesses and individuals interact with their environment, with the law stemming from the Environment Protection Act 1990. In England and Wales the regulating body is the Environment Agency. In addition, local councils have the power under the Environment Protection Act to take action against statutory nuisance and this is the area of environmental law which applies to individuals.
The area of statutory nuisance covers how individuals live in their localised environments. Statutory nuisance problems can come from your neighbours, local businesses or industries and can include:
- Smoke, from bonfires
- Fumes or gases
- Fumes, dust or smell from industry
- Littering or fly tipping
- Noise from neighbours
- Dog mess
- Nuisance from animals
- Graffiti
- Unwanted planning
Smoke nuisance is classified as air pollution which is dirty air which has the potential to damage health, plant or animal life. Air pollution can come from your neighbours or can be fumes from local industry. It is not to say that your neighbours or the local industry cannot produce smoke but it must be managed and of a level that does not unreasonably affect your daily life.
